When it comes to Duncan’s Race, Gates picks the winners.

This all has the smell, or should I say stink, of the scandal rich Reading First scheme of the Bush administration.

The Duncan USDE sets up a contest among states as to who will receive some of the Race to the Top 5 billion in funding. They set up requirements that drive all kinds of unproven theories such as linking teacher evaluation to test scores.

Now the Gates Foundation says they and the alone will pick the states to receive a quarter million in grant money to help procure RttT funding. They alone will decide who gets the money.

Of course it’s not ethical. Is it legal?

    The scary thing is that this is a *moderation* of their previous position, which was that they’d just pick who they wanted, without even asking for applications or setting criteria, period. Allowing states to apply for the help is a concession.
