No way is Cutler coming back.

Appearing on Ken Davis’ Chicago Newsroom a few weeks back I made a prediction about the legal prospects for SB1, the pension bomb sponsored by the Illinois Democrats and supported by Republicans like Bruce Rahmer and the Representative from ALEC, Darlene Senger.

I told Ken that the impact of the bill on retirees was the poison pill for the bill. It doesn’t even offer a pretense of consideration.

Glen explains the issue of consideration in an important post today.

Simply stated, “Consideration is when a claimant promises something in exchange for the defendant’s promise, [or] the inducement to a contract, something of value given in return for a performance or a promise of performance by another, for the purpose of forming a contract…” (Law Dictionary).

Current retirees, many of whom will lose as much as 30% of our retirement savings over the next 20 years, receive nothing in exchange.

Very inconsiderate.

“The bill will go down,” I told Ken.

“Really? You think the courts will rule in your favor?”

In a moment of confusion and silly optimism I said they would.

On the other hand I picked the Bears to beat Green Bay and if they didn’t there was no way Cutler was coming back.

Here are my predictions: SB1 will be thrown out, except for the part about actives paying 1% less, Madigan will admit that he set Squeezy up because Squeezy got on his nerves, Cutler will get a new multi year contract with the Bears. Nekgrinch and Biss will lose their next elections (I hope) but will marry and be miserable forever after – likes attract.

  2. Governor Idiot says he thinks that the law will be found constitutional. Fair enough, that’s an opinion. Speaker of the House, Bozo the Clown, says he has the 4 votes on the court needed to pass it. How does he already know that?!? They have not even HEARD the case yet!!!! Maybe something illegal is going on?!? Time to look into possible criminal activity by Speaker Bozo?
